FAA Waives 2028 Emissions Deadline, Letting Boeing Build 35 More 777 Freighters

The U.S. Federal Aviation Administration has granted Boeing an exemption from an incoming international emissions rule that would otherwise have forced the company to stop building its 777 Freighter at the end of 2027, according to reporting published September 17, 2026 by Leeham News, FlightGlobal and Air Cargo News. The waiver allows Boeing to certify as many as 35 additional 777Fs — the current-generation, twin-engine widebody freighter built on the "classic" 777 airframe — through January 1, 2031, buying time for the aircraft's intended replacement, the 777-8F, whose entry into service has itself been repeatedly pushed back.

The rule Boeing needed to escape

The deadline in question traces back to a 2017 decision by the International Civil Aviation Organization (ICAO), the United Nations aviation body, which set new carbon-dioxide emissions limits for aircraft designs. Under the FAA's implementation of that ICAO standard, any airplane type that had not already been certified would need to meet the new, stricter emissions requirements starting January 1, 2028 — a deadline the current 777F design, based on an airframe and engine combination first certified decades ago, would not meet. Absent an exemption, Boeing would have been barred from issuing new certificates of airworthiness for the 777F after that date.

The FAA's newly granted exemption applies specifically to the issuance of first certificates of airworthiness for up to 35 777F airplanes, running from the January 1, 2028 deadline through January 1, 2031. In practical terms, that gives Boeing roughly three additional years in which it can keep building and delivering the current 777 Freighter model to airline and cargo customers, even after the emissions rule would otherwise have shut the line down.

Why Boeing needed the extra runway

The exemption exists because of a domino effect inside Boeing's own widebody program. The 777F's planned successor is the 777-8 Freighter, a variant of the new-generation 777X family that also includes the passenger-carrying 777-9. But the 777X program as a whole has been delayed for years, hit by a mix of certification setbacks, engine-development issues with General Electric's GE9X, and heightened regulatory scrutiny of Boeing following the 737 MAX crashes and the 2024 door-plug blowout on an Alaska Airlines MAX 9. Boeing now expects 777X certification only in 2027, roughly six years behind the aircraft's originally promised entry-into-service date, with 777-9 passenger deliveries following shortly after.

Because the freighter variant's development has been explicitly tied to the baseline 777-9's certification schedule, the 777-8F's own entry into service has slipped in tandem — Boeing's current guidance points to around 2029, with some airline customers reportedly bracing for an even later arrival, into 2030. That left a widening gap: the current 777F was set to lose its ability to be newly certified in 2028, while its replacement would not be ready until at least a year later, and potentially longer. Without the FAA's waiver, Boeing said that gap could have cost the U.S. more than $15 billion in aircraft exports, since the 777F is the only large widebody freighter still in production anywhere in the world — Boeing's chief rival, Airbus, does not currently build a comparably sized new-production freighter of that size, leaving airlines with limited large-freighter options if the 777F line had gone dark.

A program plagued by delay after delay

The 777X's troubled path helps explain why Boeing found itself needing emergency regulatory relief rather than a smooth handoff between freighter generations. The 777-9's first flight slipped from an original 2019 target into 2020 because of compressor issues, and in 2022 Boeing had to pause flight testing entirely after a temperature-related issue was found in a GE9X engine during a borescope inspection. The program was set back again in 2024, when cracks were discovered in the aircraft's thrust links, grounding the 777X test fleet and pausing flight testing into 2025. Later that year, in October 2025, Boeing pushed the first 777X delivery from 2026 to 2027 — and in January 2026 the company disclosed yet another GE9X durability issue, this one serious enough that GE Aerospace temporarily paused GE9X engine deliveries in July 2026 while it worked through the problem. Boeing has said it expects engine shipments to resume, and reporting from September 2026 indicates the remaining certification hurdle is tied to securing ETOPS authorization — the approval that allows twin-engine aircraft to fly extended routes over water or remote terrain — which itself depends on resolving what Boeing has described as a "mid-seal issue" with the engine.

Taken together, those setbacks mean 777-9 certification now stands roughly seven years behind the timeline Boeing originally promised when the 777X program was launched. Because the 777-8F freighter variant is certified on the same basic airframe and engine combination as the 777-9, every one of those delays has pushed the freighter's own in-service date further to the right — which is precisely the chain of cause and effect that left Boeing needing the FAA's emissions exemption in the first place: a freighter replacement that could not be ready before its predecessor was set to age out of the certification rules.

A market that's smaller than the waiver suggests

The scale of the exemption is notably larger than Boeing's current order book for the aircraft. While the waiver permits certification of up to 35 additional 777Fs, Boeing had only 38 unfilled 777F orders on its books as of the end of August 2026 — meaning the exemption is sized to cover essentially all of Boeing's existing freighter backlog for this variant, rather than opening the door to a large new wave of sales. Boeing delivered 18 777Fs in the first eight months of 2026, after delivering 35 of the aircraft across all of 2025, giving a sense of the pace at which the remaining backlog might be worked through over the exemption's roughly three-year window.

That backlog math matters because it shapes how the waiver will actually be used. Rather than functioning as an open invitation for airlines to place large new freighter orders, the exemption more closely resembles a bridge loan: it lets Boeing finish delivering aircraft that customers have already committed to buying, without those customers being stranded by a production cutoff that arrived before the replacement aircraft was ready. Cargo airlines that had ordered 777Fs anticipating deliveries into the late 2020s can now expect Boeing to fulfill those contracts on something closer to the originally planned schedule, rather than facing a choice between an early, forced switch to a not-yet-certified 777-8F or scrambling to source freighter capacity elsewhere.

The bigger picture for widebody freighter supply

The episode underscores how thin the ground is on which the global air cargo industry's large-freighter capacity currently rests. With the 777F standing as the only large widebody freighter in current production, any disruption to its certification status — even a purely regulatory, emissions-related one rather than a technical or safety issue — has outsized consequences for airlines and logistics operators that rely on that aircraft type for transoceanic cargo capacity. The near-miss also illustrates the cost of Boeing's broader 777X delays: a program originally intended to smoothly hand off from the "classic" 777 to the next-generation 777X family instead created a scheduling collision that required direct U.S. government intervention, in the form of a formal regulatory exemption, to avoid a production gap.

For now, the waiver removes an immediate deadline pressure that had been building through 2026, after the FAA had given no indication by a self-imposed May 1 target date whether it would grant the extension Boeing had requested. With the exemption now finalized and running through January 2031, attention shifts back to the 777X program itself, where the real test remains whether Boeing can deliver 777-9 certification on its newly stated 2027 timeline — and, from there, keep the 777-8F's roughly 2029 target from slipping any further.
